The Case

On November 29, 2002, 7-month-old Samaisha Benson began to struggle to breathe while under the care of childcare provider Kim Hoover. After being taken to the hospital, the baby was found to have a skull fracture and bleeding on her brain and tragically passed away two days later. Doctors and authorities suspected Samaisha was a victim of Shaken Baby Syndrome. A month later, Kim was arrested and charged with murder and child abuse. β€œI've never hurt anyone in my life,” Kim says. β€œFor someone to make the accusation that I could hurt a child…It takes away from who you are.” Despite evidence of prior abuse by Samaisha’s father, Kim was convicted and sentenced to 15 years to life.
